Study permit in Canada and spouse visa.

Hi Sharon

I am from Asia currently studying in Canada for last 6 months. So I have a Canadian study permit.

Now I am planning to get married to my fiancé back in my country.

I want to know now that if I get married how do I tell the Canada High Commission regarding my status ?

Can my newly married spouse join me here in Canada?

Will he get work permit?

Hope you can help me with these questions!

Hi Lavina

Thanks for your inqiry (Please note that I am not an immigration officer)

In order to notify the Canadian immigration about your marriage you will most probably need to present a notarized marriage certificate. I would suggest that you call them directly and find out the exact procedure.

In general your spouse may join you to Canada.

Your spouse must meet all the requirements for temporary residents in Canada and must satisfy an officer that he is a genuine temporary resident who will be in Canada for a temporary stay.

In addition he may be required to provide evidence that he is a law abiding and have no criminal record.

Your spouse may apply for a work permit. Work permit for your spouse is valid for the same period of time as your Canadian study permit.

For you information accompanying spouses are eligible for an open work permit, which means they do not need a job offer or a labour market opinion from Service Canada.
