Study and live in USA with spouse

by Parneet Kaur
(New Delhi, India)

Hi Sharon.

I am a resident of India.

I will be applying for BTECH in colleges of USA . I have a good academic record.

I want my spouse to accompany me.

We eventually plan to settle there. Is it viable?

I will apply to the best university in USA as per my SAT score. My husband plans to go with me and work there.

is it possible for him to get a job there?

Please tell the procedure for him to apply for visa.

Please let me know.
Parneet Kaur

Study and live in USA with spouse

Dear Parneet Kaur

Thanks for your inquiry (please note that I am not an immigration officer).

Your spouse can accompany you to the U.S.A. He will have to apply for a F2 visa

A F2 visa holder cannot study or work in the U.S. The F2 category is solely to let a student's immediate family stay with them while they study in the U.S.

However, if your spouse qualifies for F1 status, he can apply to change status to F1 so he can go to school.

In the following links you can find Information on how to apply for USA F1 and F2 visas from New Delhi, and general information about student visas to the U.S.A.

In general a F1 visa is not a basis for obtaining a permanent residency in the U.S.A, and you are expected to depart the U.S.A when you complete your studies.

However you can apply to change your F1 non immigrant visa to another non immigrant visa category like H1B (temporary skilled worker), and then you can search for an employer who will agree to sponsor your green card to the U.S.A.

Best of Luck
Sharon
