New Application for a Canadian Student Visa after Refusal

Hi Sharon

I have a BA degree in hardware engineering from a university in Iran. I have decided to apply for MS degree in one of Canadian universities. But unfortunately I haven’t met the requirement.

While I was searching one of the universities offered me to get another BA degree from Canadian university and apply for MS degree after that.

The subject that I’ve chosen is “Computer Information Systems” which is similar to my original BA, but not exactly the same. I have to pass about 45 specialized units to graduate.

I got my admission letter from university and submitted all required document to Canadian embassy in Tehran, the officer refused my visa as he believes I am going to study the same course in Canada.

I asked the Canadian university to send me a new admission letter as well as any explanation letter that these two programs are not the same. I am also writing a cover letter to explain it as well.

Is there any other document that I can provide to prove this?

There is a sentence in that officer’s letter that makes me worry. It says that this file is closed and do not apply unless you have significant new information.

Do you think if this could consider as significant new information if we could prove that this two degrees are not the same?

Thanks for your inquiry (please note that I am not an immigration officer.

According to Canada citizenship and immigration

"If you believe that you have new information that was not previously considered or if you believe that circumstances have changed since the refusal, you may wish to submit a new application.

This new application will normally be assessed by a different visa officer and all current information will be taken into consideration.

If, however, there is no change in your situation, or no change in the purpose of your visit, it is unlikely that a new application will result in the issuance of a visa. The normal processing fees apply to all new applications.

Where a new application is submitted after a refusal, applicants should provide documents related to the new information or the change in their circumstances since the refusal or, failing that, they should provide an explanation for the new application".

So, it is basically up to the new Canadian Immigration Officer to assess and decide if the University's explanation letter is new information, if it is sufficient and if a Canadian student visa is granted.
