Can a Canadian Study Visa Holder Bring Her Spouse to Canada?

Hi Sharon,


I am on a study permit in Canada. I got married before I came to Canada, but because the marriage certificate was not issued at that time, and because my college was about to start we didn't inform the immigration office about our marriage.

Our marriage certificate has been issued a few days ago and my husband has it with him in India. I would like my husband to join me in Canada. Do I need to go to India to inform immigration office?

Please help me out.

Please note that I am not an immigration officer

I have done some research and found out the following information:

Before proceeding with the application to bring your spouse to Canada you must have a proof that you will be able to support him in Canada. Your spouse will also be required to demonstrate to a visa officer that he has sufficient ties to India to ensure his departure from Canada.

Other than that you will need to present the marriage certificate to an immigration officer. The marriage certificate must be translated (if not written in English or French) and notarized.

As regards to traveling back to India ? I believe you should consult an authorized immigration representative in Canada who is familiar with the Canadian immigration laws.

You have invited trouble for yourself by not informing the Canadian Immigration authorities while entring Canada about your marriage.

Even if you have a valid marriage certificate now, which is dated later than your departure to Canada, it still BEARS THE DATE OF MARRIAGE which is of a date that is earler than your departure.

I recommend do not apply at all, lest you may lose your current status aswell!!!!

Thanks Sarat for your comment and for the valuable information you provided.

Indeed the Canadian Embassy in India emphasizes that the applicant has to answer truthfully all the questions on the student visa application. A Failure to answer all the questions honestly may contribute to a negative decision on the application.

Therefore as Sarat says you might risk your status if you failed to mention your marriage on the student visa application.

However, in order to check this matter thoroughly I would still recommend that you consult an authorized immigration representative in Canada who is familiar with the Canadian immigration laws.
